Service agreement
In particular, you are reminded to read and fully understand this ATIPCAM Service Agreement (the "Agreement") and that minors should be accompanied by a legal guardian. Unless you have read and accepted all of the terms of this Agreement. By checking the "I agree to the ATIPCAM Service Agreement" box, you will be deemed to have accepted this Agreement and agreed to be bound by the terms of this Agreement.
This Agreement applies to ATIPCAM development. This Agreement is between you and ATIPCAM in relation to your use of the ATIPCAM Software and related services. This Agreement includes all agreements, business rules, policies and notices relating to ATIPCAM's services which have been and may continue to be published by ATIPCAM and which, when formally published, will be an integral part of this Agreement and will have the same legal effect as this Agreement.
ATIPCAM reserves the right to modify the terms of this Agreement as necessary. If you continue to use the ATIPCAM Services after the terms of this Agreement have been changed, you will be deemed to have accepted the revised Agreement. If you do not accept the modified agreement, you should stop using the ATIPCAM service.
I. User Code of Conduct
1.1. You agree to abide by the "seven bottom lines" of laws and regulations, socialist systems, national interests, the legitimate interests of citizens, public order, social morals and the authenticity of information, and not to use the ATIPCAM software and services to create, copy, publish or distribute content that interferes with the normal operation of ATIPCAM and infringes other users or third parties, including but not limited to
1.1.1 publishing, transmitting, distributing or storing content that violates national laws and regulations prohibiting:
(1) that violates the fundamental principles established by the Constitution
(2) that endangers national security, leaks state secrets, subverts state power or undermines national unity
(3) Damaging national honor and interests
(4) incites ethnic hatred, ethnic discrimination and undermines national unity
(5) Undermining national religious policies, promoting evil cults and feudal superstitions
(6) Disseminating rumours, disturbing social order and undermining social stability
(7) Disseminating obscenity, pornography, gambling, violence, terror or abetting crime
(8) Insulting or defaming others and infringing on their legitimate rights and interests
(9) Inciting illegal assemblies, associations, processions, demonstrations or gathering to disrupt social order
(10) Activities in the name of illegal civil organisations
(11) Containing other contents prohibited by laws and administrative regulations.
1.1.2 publishing, transmitting, disseminating or storing content that infringes on the legal rights of others, such as the right to reputation, portrait, intellectual property rights and commercial secrets
1.1.3 Involving the privacy, personal information or data of others;
1.1.4 publishing, transmitting, spreading harassment, advertising messages, excessive marketing messages and spam or containing any sexual or sexually suggestive messages
1.1.5 other information that violates laws, regulations, policies and public order and morals, social morals or interferes with the normal operation of ATIPCAM and infringes the legitimate rights and interests of other users or third parties.
1.2. You may use the ATIPCAM Software and ATIPCAM Services in accordance with this Agreement subject to compliance with the law and this Agreement. You are not entitled to do anything including, but not limited to, the following:
1.2.1 reverse engineering, reverse assembling, reverse compiling etc. of the ATIPCAM Software;
1.2.2 using the ATIPCAM Software to publish, transmit, distribute or store content that violates national laws, regulations and policies, endangers national security, the unity of the motherland, social stability, public order and morality, or any content that is inappropriate, insulting and defamatory, obscene or violent
1.2.3 Using the ATIPCAM software to publish, transmit, distribute or store content that infringes the legal rights of others, such as intellectual property rights and the right to trade secrets;
1.2.4 creating a false identity in order to mislead or deceive others;
1.2.5 the use of the ATIPCAM software to publish, transmit or distribute advertising and spam in bulk;
ii. intellectual property rights and ownership of content and trademarks
2.1. ATIPCAM respects intellectual property rights and is concerned with protecting the rights of its users. In the course of using ATIPCAM services, you may provide content to ATIPCAM in various ways, such as uploading and publishing. In such cases, you remain entitled to the full intellectual property rights of such content.
2.2. Content provided by ATIPCAM through the ATIPCAM website, ATIPCAM software includes, but is not limited to, text, software, sound, photos, video, graphics etc. that is not uploaded/supplied by the user. All such content belongs to ATIPCAM and the relevant rights holders and is protected by copyright, trademark, patent and other property ownership laws. Therefore, you may only use the content with the permission of ATIPCAM and the relevant rights holders and may not copy, reproduce or create derivative works in relation to the content.
2.3. All other ATIPCAM logos are trademarks of ATIPCAM ("ATIPCAM Marks"). You may not display or use or otherwise dispose of the ATIPCAM Marks in any manner whatsoever without ATIPCAM's prior written consent, nor may you indicate to others that you have the right to display, use or otherwise dispose of the ATIPCAM Marks.
Disclaimer of Liability
3.1. You understand and agree that the ATIPCAM software, like most websites and internet software, may be affected by a variety of factors including, but not limited to, user reasons, quality of network services, social environment, etc. It may also be subject to a variety of security issues including, but not limited to, the illegal use of user data by others for realistic harassment; other software downloaded and installed by users or other websites visited by users Other software you download and install or other websites you visit may contain viruses, Trojan horses or other malicious programs that may threaten the security of your terminal information and data, which in turn may affect the normal use of the ATIPCAM software. Therefore, you should be aware of the security of your information and personal data and pay attention to password protection to avoid losses.
3.2. It is the joint responsibility of ATIPCAM and you to maintain the security and normal use of the website and software. ATIPCAM will take reasonable and prudent technical measures to protect the security of your information and data in accordance with industry standards, but you acknowledge and agree that ATIPCAM cannot provide a complete guarantee in this respect.
3.3. The ATIPCAM Software may contain products or services provided by third parties. ATIPCAM and the third party are each responsible for any disputes that may arise to the extent required and agreed by law.
iv. third party software or technology4.1. The ATIPCAM Software may also use third party software or technology (including open source code and public domain code which may be used by the ATIPCAM Software, etc., as hereinafter defined), which use has been legally authorised.
4.2. If the ATIPCAM Software uses third party software or technology, ATIPCAM will, in accordance with relevant legislation or conventions, display the relevant agreements or other documentation, which may be attached to this Agreement, packaged in a specific folder in the ATIPCAM Software installation package, or via the Open Source Software page, which may be available as a "Software Usage License Agreement", "License Agreement", "Open Source License" or otherwise. The aforementioned agreements, other documents and web pages in various forms are an integral part of this Agreement and have the same legal effect as this Agreement, and you are required to comply with these requirements. If you fail to comply with these requirements, such third party or state authority may bring proceedings, impose fines or other sanctions against you and require the assistance of ATIPCAM, and you shall be solely responsible for such legal liability.
4.3. If any dispute arises from third party software or technology used in connection with the ATIPCAM software, that third party shall be responsible for resolving the dispute and ATIPCAM shall not be liable. ATIPCAM does not provide customer service support for third party software or technology and you should contact the third party if you need to obtain support.
V. Applicable Law and Dispute Resolution
5.1. These Terms and Conditions are governed by the laws of the People's Republic of China and exclude the application of all conflict of laws provisions.
5.2. In the event of a dispute, you and ATIPCAM agree to submit the dispute to the competent people's court in the place where this Agreement is signed. In the event of a conflict between the individual terms and conditions and these Terms of Service in respect of the content of the jurisdictional agreement, the individual terms shall prevail to the extent that they are binding.
